Phantom Discounts: Nike and Lululemon Sued
A wave of legal scrutiny is crashing into the retail industry as major global brands including Nike and Lululemon face lawsuits alleging they lure shoppers with deceptive "phantom discounts," a tactic where products carry inflated or fictitious regular prices designed to make markdowns look like steals.
The latest filing came last week, when Lululemon was sued in Los Angeles Superior Court by California plaintiff Annette Cody. Her complaint claims:
Lululemon lists products with "fictitious regular prices" that were never the true selling price
The company strikes through those false original prices to create "corresponding phantom discounts"
The result makes "sale" prices appear far more enticing than they actually are
Legal and marketing experts note the practice has quietly existed across retail for decades. What has changed is the volume, with a recent surge in consumer filings signaling a genuine legal trend rather than isolated complaints.
The suits land at a moment when strikethrough pricing is baked into nearly every ecommerce experience. A string of losses or settlements could force brands industry-wide to rethink how they advertise discounts online.
